1. Purpose

This SOP describes how [SITE NAME] decides which items and services in a clinical study may be billed to Medicare or other insurers as routine care and which must be paid by the sponsor or not charged at all, and how the site keeps research claims accurate. Billing an insurer for an item the sponsor already pays for, or for an item provided only for research, can create false claims liability. The coverage analysis and billing grid are the controls that prevent it.

2. Scope

This SOP applies to every study at [SITE NAME] in which any study-related item or service could be billed to Medicare, Medicare Advantage, Medicaid, a commercial insurer or a participant. It covers the coverage analysis, the billing grid, consistency checks across the CTA, budget and consent form, claim holds and review, and the claim coding required for research.

Sites that do not bill insurance. Many independent sites are paid only by the sponsor and never submit claims for study participants. If [SITE NAME] does not bill any insurer or participant for study items, the site follows the scaled-down process in 5.1 and does not need the full coverage analysis. The full process applies to any study where even one item will be billed.

Out of scope: budget negotiation (SOP-201) and participant payments (SOP-310). Where a sponsor, CRO or IRB requirement is stricter than this SOP, the site follows the stricter requirement. Payer rules change; the Quality Lead confirms the current CMS manual instructions and MAC guidance at each periodic review of this SOP.

This SOP describes operating steps. It is not legal advice; [SITE NAME] confirms legal and contracting positions with [LEGAL COUNSEL].

3. Responsibilities

RoleResponsibilities
Site DirectorDecides whether the site bills insurance for research participants at all. Owns research billing compliance. Approves each coverage analysis before the budget is final.
Finance / Contracts LeadPrepares the coverage analysis on F-202-01 and the billing grid, or manages the vendor who prepares them. Aligns the budget with the analysis. Releases held claims after review.
Principal Investigator (PI)Confirms the standard-of-care determinations and the medical necessity of items designated as routine care. Signs the coverage analysis.
Lead CRCFlags study participants in the practice management or billing system. Records each study visit with the billing designation from the grid. Tells billing about every research encounter.
Billing staff or billing serviceApplies claim holds, research coding (modifiers, condition code, diagnosis code, NCT or IDE number) and routes questions to the Finance / Contracts Lead.
Regulatory CoordinatorSupplies the protocol, IB or device information, IDE and CMS approval letters, consent form and NCT number. Files the final coverage analysis in the ISF.
Quality LeadAudits research claims (5.9) and leads CAPA for billing errors (SOP-703).

4. Definitions

TermDefinition
Coverage analysis (CA)A study-level review that determines whether a study qualifies for Medicare coverage of routine costs and, for each item and service in the protocol, who pays. Also called Medicare coverage analysis (MCA). Recorded on F-202-01.
Qualifying clinical trialA study that meets the requirements of the Medicare Clinical Trial Policy, NCD 310.1.
Routine costsUnder NCD 310.1, items and services that are otherwise generally available to Medicare beneficiaries and are typically provided absent a clinical trial, required solely for the provision of the investigational item, needed for clinically appropriate monitoring of its effects, or needed to prevent, diagnose or treat complications.
Research-only itemAn item or service provided solely to collect data for the study and not used in the participant's clinical management. Not billable to Medicare.
Sponsor-paid itemAn item or service the sponsor pays for under the CTA or provides free of charge. Never billable to an insurer or the participant.
Billing gridThe visit-by-procedure table derived from the CA that tells staff, for every protocol item at every visit, who pays and how to code it.
IDE studyA device study conducted under an investigational device exemption (21 CFR 812). Medicare coverage is governed by 42 CFR 405 Subpart B and requires CMS approval.
Category A deviceAn experimental device for which absolute risk of the device type has not been established. Medicare may cover routine care in a CMS-approved study, but not the device.
Category B deviceA nonexperimental or investigational device for which the incremental risk is the main question. Medicare may cover the device and routine care in a CMS-approved study.
Q0 modifierHCPCS modifier for an investigational clinical service provided in a clinical research study that is in an approved clinical research study.
Q1 modifierHCPCS modifier for a routine clinical service provided in a clinical research study that is in an approved clinical research study.
Condition code 30Institutional claim code identifying a qualifying clinical trial.
NCT numberThe 8-digit ClinicalTrials.gov identifier; mandatory on claims for items and services in clinical trials since 1 January 2014.
Medicare Advantage (MA)Medicare benefits delivered through a private plan under Medicare Part C.

5. Procedure

5.1 Decide whether the site will bill for the study

5.1.1
At feasibility (SOP-200) the Site Director records on F-202-01 whether any study item could be billed to an insurer or the participant.
5.1.2
If no item will be billed (the sponsor pays for every protocol item, and any standard care the participant receives elsewhere is outside the study), the Finance / Contracts Lead completes the short form of F-202-01:
  • statement that [SITE NAME] will not bill any insurer or participant for any protocol item or service
  • confirmation that the budget covers every item in the schedule of assessments
  • confirmation that the consent form does not say any study item will be billed to the participant's insurance, and does not imply cost to the participant
  • confirmation of how injury care is handled (CTA and consent form match, SOP-201)
5.1.3
For a no-billing study, the Lead CRC still flags participants in the practice management system as research participants so that clinic staff do not create claims for study visits, and the Finance / Contracts Lead checks at [DEFAULT: quarterly] reconciliation that no claim was submitted for a study visit.
5.1.4
If the site also treats the participant as a regular patient (for example a primary care or specialty practice running trials), any non-study visit may be billed normally. The Lead CRC makes sure study and non-study services on the same day are documented separately so billing can split them.
5.1.5
If any item will be billed, the Finance / Contracts Lead completes the full analysis in 5.2 to 5.8.

5.2 Gather documents

5.2.1
The Regulatory Coordinator gives the Finance / Contracts Lead: final protocol (including schedule of assessments), IB or device instructions, draft or approved consent form, draft CTA and budget, IND status or IDE number and FDA device category letter, CMS IDE approval (device studies), NCT number, and any sponsor statement on items provided free of charge.
5.2.2
The coverage analysis is done on the protocol version that will be activated and updated for each amendment (5.7).

5.3 Qualifying clinical trial determination (drugs, biologics and non-IDE studies)

5.3.1
The Finance / Contracts Lead applies NCD 310.1 and records each finding on F-202-01. The study must meet all three requirements:
  • it evaluates an item or service that falls within a Medicare benefit category and is not statutorily excluded
  • it has therapeutic intent and is not designed only to test toxicity or disease pathophysiology
  • for therapeutic trials, it enrolls participants with the diagnosed disease rather than healthy volunteers (diagnostic trials may enroll healthy participants as a control group)
5.3.2
The study must also be a deemed qualifying trial. Record which applies:
  • funded by NIH, CDC, AHRQ, CMS, DoD or VA
  • supported by centers or cooperative groups funded by those agencies
  • conducted under an IND reviewed by FDA
  • a drug trial exempt from an IND under 21 CFR 312.2(b)(1)
5.3.3
Phase 1 healthy-volunteer studies, pure pharmacokinetic studies and studies with no therapeutic intent do not qualify. In those studies nothing is billed to Medicare as a clinical trial routine cost; the sponsor pays for all study items.
5.3.4
If the study does not qualify, the Finance / Contracts Lead records that on F-202-01, and the site does not bill Medicare for any study-related item. Conventional care the participant would receive anyway, unrelated to the study and not required by the protocol, follows normal billing.

5.4 IDE device studies

5.4.1
For device studies under an IDE, the Finance / Contracts Lead records the FDA device category (A or B) and confirms CMS has approved the study for Medicare coverage under 42 CFR 405 Subpart B. CMS has centralized this review since 1 January 2015 and lists approved studies on its website. The sponsor requests CMS approval; the site obtains a copy of the approval letter.
5.4.2
Without CMS approval, the site does not bill Medicare for the device or for routine care in the study.
5.4.3
With CMS approval:
  • Category A: routine care items and services may be billed; the device may not
  • Category B: routine care and the device may be billed, unless the sponsor provides the device free or reimburses it, in which case the device is not billed
5.4.4
Studies under Coverage with Evidence Development (CED) NCDs follow the specific NCD requirements; the Finance / Contracts Lead records the NCD number and CMS approval on F-202-01.

5.5 Item-by-item determination

5.5.1
For each item and service at each visit in the schedule of assessments, the Finance / Contracts Lead records on F-202-01:
  • the item and visit
  • whether it is standard of care for this population at this frequency, with the basis (national guideline, NCD or LCD, published standard, PI attestation on site practice)
  • whether the sponsor pays for it or provides it free under the budget or CTA
  • the determination: sponsor-paid (S), routine and billable (R), research-only not billed (N), or not applicable
5.5.2
The following are never billed to Medicare or the participant:
  • the investigational item itself, unless otherwise covered outside the trial (for example a Category B device or an approved drug used on label, where coverage rules allow)
  • items and services provided solely for data collection and not used in clinical management (for example extra pharmacokinetic draws, research-only imaging)
  • items customarily provided free of charge by the sponsor
  • any item or service the CTA budget pays for, even if it is also standard of care
5.5.3
The PI reviews each R determination and confirms the item is medically necessary and would be provided at that frequency absent the study. The PI signs F-202-01.
5.5.4
The Site Director approves the coverage analysis. The Finance / Contracts Lead does not finalize the budget until the CA is approved, so every S item is funded and no R item is also in the budget.

5.6 Consistency across documents

5.6.1
Before activation, the Finance / Contracts Lead checks and records on F-202-01 that the following agree:
  • CA and budget. Every S item is paid in the budget. No R item is paid in the budget.
  • CA and CTA. The CTA payment terms and subject injury terms match. Injury care the sponsor pays is not billed to Medicare.
  • CA and consent form. The costs section of the consent form tells participants which items may be billed to their insurance and that they may owe copays and deductibles for those items, and that sponsor-paid and research-only items are free to them. Wording about injury costs matches the CTA.
  • CA and billing grid. The billing grid reproduces the CA designations exactly.
5.6.2
Any inconsistency is resolved before activation, by budget renegotiation (SOP-201), consent revision and IRB submission (SOP-203), or CA correction. The approved coverage analysis is an item on the activation checklist F-205-01.

5.7 Billing grid and amendments

5.7.1
The Finance / Contracts Lead issues the billing grid to the Lead CRC and billing staff before the first participant visit and files it in the ISF.
5.7.2
For every protocol amendment that changes visits or procedures, and for every budget amendment, the Finance / Contracts Lead updates F-202-01 and the billing grid, the PI and Site Director re-approve, and the Regulatory Coordinator files the new version. The grid shows its version and effective date. Staff use only the current version.

5.8 Claims: flags, holds, coding and review

5.8.1
When a participant consents, the Lead CRC flags the participant's account in [PRACTICE MANAGEMENT SYSTEM] as a research participant with study name and NCT number. The flag triggers a hold on all claims for that participant.
5.8.2
For each study visit, the Lead CRC records the visit and marks each service with its grid designation (S, R or N) on the encounter or charge form, and sends it to billing within [DEFAULT: 2 business days].
5.8.3
Billing staff code R items on claims for qualifying trials and approved IDE studies as follows, subject to current CMS and MAC instructions:
  • Q1 modifier on routine clinical services; Q0 modifier on investigational clinical services that are billable (for example a covered Category B device)
  • ICD-10-CM Z00.6 as a secondary diagnosis for qualifying clinical trials
  • condition code 30 on institutional claims
  • the NCT number: value code D4 on institutional claims; item 19 with the prefix CT on paper professional claims, or the equivalent electronic field (837P loop 2300 REF, qualifier P4) without the prefix
  • the IDE number for device studies, in the field the MAC requires
5.8.4
Billing staff remove S and N items from claims. S and N items must not appear on a claim to any payer or on a participant statement.
5.8.5
The Finance / Contracts Lead or a trained reviewer compares each held claim against the billing grid, the visit documentation and the participant's study status (consented, active, off study) before release. Claims are released only after review. The reviewer records the review in [CLAIM REVIEW LOG].
5.8.6
If a sponsor-paid or research-only item is found to have been billed, the Finance / Contracts Lead corrects or voids the claim, refunds any payment received from the payer or participant, records the event, and opens a CAPA under SOP-703. Overpayments to Medicare must be reported and returned within 60 days of identification (42 U.S.C. 1320a-7k(d); 42 CFR 401.305); the Site Director consults [LEGAL COUNSEL] on when an overpayment counts as identified.

5.9 Commercial insurance, Medicaid and Medicare Advantage

5.9.1
Commercial plans and Medicaid: the Affordable Care Act (42 U.S.C. 300gg-8) requires non-grandfathered group and individual plans to cover routine costs for qualified individuals in approved clinical trials (phase I to IV trials for cancer or another life-threatening disease or condition), and many states have similar laws. Plan rules vary. The Finance / Contracts Lead checks plan requirements (prior authorization, in-network rules) before the first billable visit and records the result. Medicaid coverage of routine costs in qualifying trials follows 42 U.S.C. 1396d(gg) and state rules.
5.9.2
Medicare Advantage: for qualifying clinical trials under NCD 310.1, routine costs for MA enrollees are billed to Original Medicare through the MAC, not to the MA plan, and the MA plan covers the difference in cost-sharing. For CMS-approved IDE studies, the MA plan is responsible for covered routine costs and devices. The Finance / Contracts Lead confirms the current CMS instruction before billing MA enrollees and records it on F-202-01.

5.10 Monitoring and audit

5.10.1
The Quality Lead or a delegate audits a sample of research claims at least [DEFAULT: annually], comparing claims with the billing grid, visit documentation and sponsor payments, and records results on F-700-02.
5.10.2
The Finance / Contracts Lead reviews sponsor payment reconciliations (SOP-201) for any item that was both paid by the sponsor and billed to an insurer.

5.11 Records

5.11.1
The Regulatory Coordinator files the approved F-202-01, each billing grid version, CMS IDE approval letters and claim review records for the study in the ISF or in [BILLING COMPLIANCE FOLDER], with a pointer in the ISF index (F-204-01). Billing records are retained for the longer of the study record retention period (SOP-402) and [DEFAULT: 10 years] for claims records.
